From John Jay to Benjamin Moore, 22 April 1804

To Benjamin Moore

Bedford 22 ap. 1804

Sir

I have been favored with your Letter of the 13 Inst.1 communicating to me the following Resolution of the Vestry of Trinity Church—

“Resolved that the Rt. Revd. the Bishop be requested to return the thanks of this Board to Mr. Jay, for his obliging offer to accommodate them with his Lots in order to have a new church built on them; & to inform him that upon a full Consideration of the Subject, the Board is of opinion they will not answer the intended purpose.”

Any person unacquainted with the whole of the Transaction, would probably, and I think not unfairly, understand and infer from this Resolution that

That Mr. Jay, knowing the Desire of the Vestry to purchase Ground for a new church in that part of the town, thought it a good opportunity of disposing of his Lots to advantage, and therefore obligingly offered them to the Vestry for that purpose.

I never Sir! did offer those Lots directly or indirectly, to the Vestry, nor to any other person or persons whatever. The Fact is that the Vestry (as I understood it) did by Mr Jacob Le Roy, apply to me for those Lots; and that I did consent that they shd. have them at their real Value, to be ascertained by appraisers— specifying no Terms but what related to the payment and application of the Money— Whether Mr Le Roy was formally or informally authorized or requested to make the application from I know not— He made it however on their Behalf ^as mentioned in my Letter to you of the 9th. ult.^—2

I am persuaded that the Variation of the Resolution from the Fact was inadvertent, and that the Vestry on being apprized of it, will correct that Error in the Record kept of their proceedings. Be pleased ^Sir!^ to mention it to them, and permit me to request the favor of you to inform me of the Result—3 I am Sir with great Respect & Esteem Your most obt. Servt
