65. With the cessation of his monthly salary in 1809, TJ had found himself without funds for large cash payments. He had intended using the quarterly rent from his Shadwell mill to pay for his quarterly shipments of nailrod, but circumstances subverted his financial plans. The inadequate trickle of rent payments from Jonathan Shoemaker was distributed to pressing local creditors, so that TJ was forced to ask Jones & Howell for nailrod on credit. This they were happy to do, but TJ was never comfortable with this arrangement and, until the complete shutdown of the nailery in the War of 1812, he stopped making nails whenever he had used up two unpaid shipments of nailrod until he could make a remittance to his Philadelphia suppliers (TJ to Jones & Howell, 10 Aug. 1809, 7 Apr. 1810, 3 Apr. 1811; Jones & Howell to TJ, 16 Aug. 1809).

66. For £1,200 TJ sold Samuel J. Harrison of Lynchburg the remaining 474 acres of the Judith’s Creek plantation inherited from John Wayles: the Tullos and Stith tracts on Ivy Creek in Campbell County. This first sale of detached lands for the repayment of TJ’s presidential debts was plagued by the conflicting claim of Samuel Scott to fifty acres of the Stith tract (MB 15 Apr. 1775, 17 Nov. 1796, 11 Apr. 1810; Campbell County Deed Book, ix, 94, Campbell County Courthouse, Rustburg, Va.; TJ to MJR, 2 Mch. 1809; TJ to James Martin, 17 Nov. 1809; Martin to TJ, 15 Jan. 1810). Harrison, who became TJ’s friend, was a prominent Lynchburg tobacco merchant (Philip Lightfoot Scruggs, The History of Lynchburg, Virginia, 1786-1946 [Lynchburg, Va., n.d.], p. 32-7).

67. Here and in 1811 TJ paid for six tons of gypsum plaster for use as a soil dressing. He purchased it in lump form and ground it in the Shadwell toll mill (TJ to John Hollins, 5, 16 Feb. 1810; MB 4 Apr. 1811).

68. Bedford County attorney and former TJ supporter in Congress Christopher Clark (1767-1828) was representing TJ in a suit against Samuel Scott for forcible entry. Scott had begun building on the Stith tract TJ had recently sold to Samuel J. Harrison. In 1812 Scott in his turn brought chancery suits against TJ and Harrison, claiming title to half of the 100-acre Stith tract. TJ hired George Hay and William Wirt to defend him and, after troublesome record searches and paperwork, Scott’s suit was dismissed in 1814, with costs awarded to TJ. Most of the documents concerning these cases are in ViU (MB 7 Apr. 1810; Burgess Griffin to TJ, 27 Dec. 1809; TJ to James Martin, 18 Feb. 1810; TJ to Hay, 13 July 1812; Hay to TJ, 8 Mch. 1815).

70. By this release, recorded 5 Mch. 1810, TJ relinquished all claim to the eastern half of the 1000-acre Southwest Mountain tract northeast of Lego for which he had obtained an order of council in 1773 (AlCDB, xvii, 93-4; MB 13 Nov. 1772, legal notations). Because of delays in surveying, TJ had received a patent for only the western half of the tract, while Thomas M. Randolph, Sr., and John Harvie, Jr., acquired the remaining 490 acres from James Marks, the patentee. After lengthy negotiations TJ and Harvie agreed to share equally the 245-acre parcel which they both claimed and which adjoined Harvie’s Belmont plantation. Harvie sold Belmont and paid TJ £402–17 for his 122½-acre share, that is, £3–5–9¼ per acre, the same per-acre price Harvie received for the whole plantation. The payments were made over seven years and do not all appear in MB (TJ to Harvie, 10 Feb., 15 Nov. 1810; “Compromise,” 17 Feb. 1810, MHi; Harvie to TJ, 18 Oct. 1810).

72. TJ’s hired slave Tom Buck had run away early in the year and returned with frostbite. These charges were deducted from TJ’s payment for the slaves hired through William Chamberlayne (TJ to Chamberlayne, 17 Aug. 1810, 6 Jan., 4 Apr., 24 June 1811).
