TJ evidently requested that the Heads of Departments send recommendations for appointments to be acted on by the Senate before the close of the session. Dearborn sent his nominations in letters to TJ of 9, 16, and 17 Apr. The arrangement of the War Department nominations in the list above indicates that the president did not start the list until he had all of Dearborn’s recommendations. Gallatin was probably the last to provide candidates. It was the subject of his letter to TJ of 24 Apr. At the end of the letter Gallatin provided information, which prompted TJ to cancel the nomination of Thomas N. Brickell. See TJ to the Senate, 27 Apr., for the final list of nominations.

On 13 Apr., Brockholst Livingston wrote the secretary of state recommending William CUTTING, a New York City attorney who had married into the Livingston family, as a commissioner of bankruptcy. The appointment did not require Senate approval. Cutting did not receive the appointment (RC in DNA: RG 59, LAR, endorsed by TJ: “Livingston Brockhorst, to mr Madison Wm. Cutting of N.Y. to be Commr. bkrptcy”; Madison, Papers description begins William T. Hutchinson, Robert A. Rutland, J. C. A. MICHAEL MC.CLARY: John Langdon wrote Madison on 6 Apr. recommending McClary, who served as a state senator and adjutant general of New Hampshire, as marshal. He received the appointment and served in the position until the year of his death (RC in DNA: RG 59, LAR, endorsed by TJ: “<mr Langdon to mr Madison> Michael McClary to be Marshal v. Ser., 2009–, 1 vol. description ends , Sec. of State Ser., 3:106–7). Edward HARRIS served as U.S. judge for the fifth circuit during the remaining months of the court’s existence. He went on to represent New Bern in the state legislature and in 1811 was elected a judge of the North Carolina Superior Court (William S. Powell, ed., Dictionary of North Carolina Biography, 6 vols. Richard HOWARD served as master and JOSEPH SAWYER as first mate of the revenue cutter on the Delaware River until Howard was dismissed for misconduct in 1805.
